About these Terms

These Terms of Service apply when you browse or use the The Plant Boys website or place an order with us. By doing so, you agree to these Terms. If you are under 18, please use the website and place orders with the permission of a parent or guardian.

"The Plant Boys", "we", "us" and "our" means The Plant Boys AU (ABN 36 144 763 624).

Products, availability and product information

We work hard to describe and photograph products accurately. However, plant size, colour, growth habit and appearance naturally vary, and screen displays may not show colours exactly. Product availability can change quickly, particularly for living plants.

We may correct genuine errors in product information, pricing or availability. If an error affects your order, we will contact you and, where appropriate, give you the option to proceed, amend or cancel the order and receive a refund of amounts paid.

Orders and payment

Please provide complete and accurate order, delivery and contact details. An order confirmation acknowledges that we have received your order; it does not guarantee that a product remains available. We may decline or cancel an order before dispatch where a product is unavailable, there is a genuine pricing or listing error, fraud is suspected, or we are required to do so by law. If we cancel an order after payment, we will refund the affected amount.

Prices are shown in Australian dollars and include GST unless stated otherwise. Shipping charges and available delivery options are shown at checkout.

Shipping, delivery and pickup

Our Shipping Policy forms part of these Terms. It explains our delivery areas, dispatch times, Express Post plant shipping, local shipping discount, pickup arrangements and delivery estimates.

Delivery estimates are estimates only. Please make sure your delivery address is correct and let us know promptly if it needs to change. We cannot guarantee changes once an order has been prepared or lodged with Australia Post.

Returns, refunds and cancellations

Our Refund Policy forms part of these Terms. It explains change-of-mind returns for eligible non-plant items, plant issues, return shipping, cancellations and refunds. It also explains the $7.95 cancellation fee that applies where an accepted change-of-mind cancellation is requested after picking and packing has started but before dispatch.

Gift cards and products clearly identified as clearance or final sale before purchase are not eligible for change-of-mind returns. This does not affect your rights under the Australian Consumer Law.

Acceptable use

You must not misuse this website, interfere with its security or operation, use it for unlawful purposes, submit false or misleading information, infringe another person's rights, introduce malicious code, or scrape or harvest data from it without our permission.

Intellectual property

Unless otherwise stated, the website content, branding, photographs, text and other materials are owned by or licensed to The Plant Boys. You may use the website for personal shopping purposes, but may not reproduce, distribute or commercially use its content without our written permission.

Third-party services and links

Our website may link to, or use services provided by, third parties such as Shopify, payment providers and Australia Post. Those services are subject to their own terms and policies. We are not responsible for third-party websites or services outside our reasonable control.

Privacy

Our Privacy Policy explains how we collect, use and protect personal information.

Australian Consumer Law and liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or another law where it cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not liable for indirect or consequential loss that is not reasonably foreseeable. Nothing in this section is intended to limit liability where doing so would be unlawful.

Changes to these Terms

We may update these Terms from time to time by publishing the updated version on this page. The version that applies to an order is the version available when you place that order, unless a change is required by law or you agree otherwise.

Governing law

These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.
